BIBI Reacts To Supreme Court Ruling, Says Electoral Law Settles Dispute Over NDC Candidature

Hon. Sunday Aguebor, popularly known as BIBI, has reacted to the recent Supreme Court ruling on key provisions of the Electoral Act, saying the judgment has important implications for the ongoing controversy surrounding the Nigeria Democratic Congress (NDC) candidature in Edo State ahead of the 2027 general elections.

The Supreme Court, on Thursday, September 24, 2026, upheld key provisions of the Electoral Act 2026 relating to political party membership registers and the nomination of candidates for elections.

Reacting to the development, BIBI said the judgment reinforces the need for strict compliance with the Constitution, the Electoral Act and the rules governing political party primaries and candidate nomination.
BIBI RAISES QUESTIONS OVER NDC NOMINATION

BIBI said the controversy centres on the NDC's nominations for the Edo South Senatorial District and the Egor/Ikpoba-Okha Federal Constituency.

According to him, Mrs. Epele Osayuki Asemota participated in the NDC primary for the Egor/Ikpoba-Okha Federal Constituency, while he, Hon. Sunday Aguebor, was declared the party's candidate for the Edo South Senatorial District.

He further stated that the NDC subsequently forwarded nomination documents to the Independent National Electoral Commission (INEC), including the relevant Forms EC9.
a
BIBI also raised concerns over a letter allegedly dated July 6, 2026, which, according to him, bears an INEC stamp indicating that it was received on August 5, 2026.

He questioned the circumstances surrounding the document and said he possesses Certified True Copies of relevant documents which, in his view, establish the sequence of events surrounding the nominations.
"THE LAW MUST PREVAIL"

BIBI maintained that the Supreme Court's pronouncement on the Electoral Act must be respected by all parties involved in the dispute.

He argued that the provisions governing party membership, participation in primaries and candidate nomination must be applied consistently and transparently.

According to him, the issue is not merely about an individual candidate but about adherence to the rules governing the electoral process and respect for the mandate produced through a valid party primary.

BIBI said he would continue to pursue the matter through the appropriate legal channels and rely on documentary evidence and the relevant provisions of the law.
ONGOING COURT PROCEEDINGS

The controversy surrounding the NDC's Edo South Senatorial District ticket remains the subject of litigation.

A Federal High Court in Abuja has reportedly fixed November 26, 2026, for judgment in a suit challenging aspects of the NDC's nomination process for the Edo South Senatorial District.

The ongoing judicial proceedings mean that the final legal position on the competing claims to the NDC ticket remains subject to the determination of the courts.
BIBI: "THE PEOPLE'S MANDATE MUST BE PROTECTED"

BIBI assured his supporters that he would continue to pursue the matter peacefully and within the ambit of the law.

He said the records relating to the primaries and subsequent submissions to INEC should be allowed to speak for themselves, stressing that the rule of law must guide the process.

He called on his supporters to remain calm and law-abiding while the relevant legal processes run their course.
